Advocai LLP has been retained by former patients of Ontario dentist, Dr. Hisham Kaloti to advance claims against him for dental negligence and battery. Lawsuits have been filed in the Ontario Superior Court of Justice.
These lawsuits allege that Dr. Kaloti performed procedures on former patients using unlicensed, non-Health Canada approved veneers and crowns that he sourced from an unregistered Chinese laboratory called Foo Tian Dental Laboratory. The claims allege that Dr. Kaloti installed the Foo Tian hardware in his former patients’ mouths without disclosing the origin or unlicensed status of the laboratory, veneers and crowns.
The claims allege that Dr. Kaloti’s conduct amounts to battery and negligence. The claims allege that this battery, negligence and use of unlicensed dental hardware has resulted in significant injuries and complications for many former patients. The alleged complications include the failure of the dental hardware, chipping, discoloration, bite misalignment, damaged teeth and jaw injury. Our clients are seeking damages for their pain and suffering, the cost of replacement of their dental hardware, the cost of other corrective dental work, their other medical costs and their lost income.
The claims also allege that Dr. Kaloti used the Foo Tian veneers and crowns in order to profit off of the difference in cost between unlicensed dental hardware and dental hardware that is designed and manufactured in accordance with provincial and federal regulations. The plaintiffs seek punitive and aggravated damages against Dr. Kaloti for his alleged reprehensible conduct and intentional wrong-doing.
Given the nature of Dr. Kaloti’s alleged conduct, many of his former patients are unaware of the true origin of their veneers, crowns or other dental hardware. Advocai encourages former patients of Dr. Kaloti to contact to us for support in investigating their own claims and seeking justice.
